Suspended Chief Justice Seeks Supreme Court Injunction Against Removal Inquiry

Suspended Chief Justice Gertrude Torkornoo has filed a legal application seeking to halt the five-member committee investigating petitions for her removal from office. The suit was submitted to the Supreme Court on Wednesday, May 21, 2025.

Mrs. Torkornoo is requesting an interlocutory injunction to stop all proceedings of the committee until the case is finally resolved.

According to the court documents, she is asking the Supreme Court to issue an order preventing the committee—comprising Justices Gabriel Scott Pwamang and Samuel Kwame Adibu-Asiedu, former Auditor-General Daniel Yao Domelevo, Major Flora Bazuwaaruah Dalugo, and Professor James Sefah Dziasah—from continuing any inquiries.

The application also requests that Justices Pwamang and Adibu-Asiedu be prohibited from presiding over or participating in the committee’s deliberations.

This comes after claims by New Patriotic Party (NPP) member Alfred Ababio Kumi, also known as Adenta Kumi, who alleged that Justices Pwamang and Adibu-Asiedu, along with Supreme Court Justice Yonny Kulendi, were seen discussing Mrs. Torkornoo’s removal at a restaurant. Kumi also alleged that Thaddeus Sory, the lawyer for one of the petitioners, was present at the meeting.

Kumi argues that this alleged meeting undermines the integrity of the inquiry, leading him to petition for the committee’s dissolution.

Additionally, the Chief Justice is seeking the suspension of the suspension warrant issued by the President under Article 146(10) of the Constitution until the case is resolved.

Her legal team at Dame and Partners filed the suit, which is expected to be heard by the Supreme Court in the coming days.
