The Land Division of the High Court in Accra has granted an interim injunction to Labadi Beach Hotel, restraining Spartan Ives Limited, the operators of Polo Beach Club, from encroaching on the hotel’s property.
The court’s decision, issued on December 19, 2024, follows a legal action filed by Hotel Investments (Ghana) Limited, the owner of Labadi Beach Hotel, aimed at reclaiming a disputed portion of land.
In its ruling, the court outlined several restrictions, prohibiting Spartan Ives Limited and its affiliates from the following actions:
- Trespassing on 0.54 acres of Labadi Beach Hotel’s property, which includes areas currently used as a car park, a pathway, and venues for events.
- Operating the Polo Beach Club or hosting any events on the hotel’s land or in adjoining restricted areas.
- Using the beachfront adjacent to the hotel’s property in violation of a lease agreement dated November 27, 1990.
The injunction, which is set to remain in effect for 10 days, also warns the defendants of possible contempt proceedings if they fail to comply with the court’s orders.
This legal action underscores Labadi Beach Hotel’s resolve to protect its property from encroachment. The hotel’s management, led by David Eduaful, has submitted supporting affidavits to assert its rights and safeguard its status as Ghana’s premier 5-star beach resort.
