Supreme Court Grants NDC Extra Time to Respond to EC

Story Highlights
  • NDC gets more time to respond to EC
  • Election results dispute ongoing, Ablekuma North pending
  • Substituted service ordered for NPP candidates

The Supreme Court has granted permission to the National Democratic Congress (NDC) and its parliamentary candidates for Okaikwei North, Ablekuma North, Tema Central, and Techiman South to file a response to the Electoral Commission (EC).

The case arises from a Certiorari application filed by the NDC and its four candidates, challenging the EC’s handling of election results in these constituencies.

Following the application, the High Court in Accra instructed the EC to compile and declare the election results. Since then, the EC has declared results in three of the four constituencies, with Ablekuma North still pending.

Initially, the applicants encountered difficulties in serving the New Patriotic Party (NPP) candidates. However, the Supreme Court intervened, directing that substituted service be used to ensure proper legal procedures.

When the case was heard on Thursday, April 3, the applicants’ lawyers requested additional time to respond to the EC’s reply. Lawyer Justin Amenuvor, representing the EC, opposed this request, arguing that the legal window for a response—seven days after service—had already passed.

Despite this objection, the Supreme Court granted the applicants an extra seven days to file their response, allowing the legal process to continue.
