High Court Rules Against WAEC, Orders Release of Withheld WASSCE Results

An Accra High Court has rejected the West African Examinations Council (WAEC) application for a stay of execution on a previous ruling that mandated the release of withheld West African Senior School Certificate Examination (WASSCE) results.
In December 2024, WAEC had announced the withholding of results for about 10,000 WASSCE candidates across various subjects, citing alleged examination malpractices and irregularities. However, following a petition filed by four students representing all affected candidates, the High Court ruled on January 30, 2025, that the results be released.
The court instructed WAEC to release the results without any prejudicial footnotes, deeming the council’s justification for withholding the results as ambiguous and inconsistent. The ruling emphasized that the continued withholding of results could significantly hinder the academic and professional progress of the affected students.
Despite the ruling, WAEC sought a stay of execution pending an appeal. However, during a hearing on February 20, 2025, Justice Ali Baba Abature, who presided over the case, dismissed WAEC’s application. The judge stated that WAEC had failed to provide sufficient justification for their actions.
In addition to rejecting WAEC’s application, the court imposed a GHS 5,000 fine on the council.
