The Accra High Court has ruled in favor of Tobinco Pharmaceuticals Limited and its Group Chairman, Elder Dr. Samuel Amo Tobbin, in a long-standing legal dispute.

The court found that the company did not import fake drugs into Ghana, as alleged by the Food and Drugs Authority (FDA) in 2013.

The FDA, under the leadership of Dr. Stephen Kwabena Opuni, had taken punitive measures against Tobinco, including closing its warehouses, confiscating and destroying products, and banning its business partner from exporting drugs to Ghana.

These actions caused significant financial losses and damage to Tobinco’s reputation.

The court determined that the FDA’s actions were unlawful, as they lacked necessary approval from the Minister of Health.

The court also found that Tobinco’s CEO and another director were coerced into signing “confession” statements, which were later discovered to be fabricated.

The court’s ruling marks the end of a protracted legal battle that began over a decade ago.

Tobinco Pharmaceuticals has expressed relief and gratitude at the judgment, which vindicates the company and its chairman.

The company has reiterated its commitment to producing and distributing quality drugs and has thanked Ghanaians for their support during the difficult period.
