The Accra High Court has exonerated Tobinco Pharmaceuticals Limited (TPL) and its Group Chairman, Elder Dr. Samuel Amo Tobbin, from allegations of importing counterfeit drugs into Ghana.
This decision, delivered by Her Ladyship Audrey Kocuvie-Tay on July 29, 2024, stands in contrast to the accusations previously asserted by Dr. Stephen Kwabena Opuni, the former Chief Executive Officer of the Food and Drugs Authority (FDA).
The ruling concludes a protracted legal dispute that began on July 19, 2019. According to a press release from Tobinco Pharmaceuticals, the court determined that the allegations were unfounded and that the FDA, under Dr. Opuni’s leadership, engaged in an abuse of authority.
The press release highlighted that the court identified coercion in the process of obtaining confession statements from Elder Dr. Tobbin and Mr. Kamath, with documents prepared by the Bureau of National Investigations (BNI) using Tobinco’s letterhead.
Additionally, the court deemed the FDA’s actions—specifically the prohibition of Tobinco’s products and the export ban on Bliss GVS Pharma Limited’s products to Ghana—as unlawful, citing a lack of proper authorization from the Minister of Health.
Tobinco Pharmaceuticals and its CEO expressed their satisfaction with the court’s decision, welcoming the favorable outcome.
